Sandoz has requested an extension of its deadline to file a petition for a writ of certiorari in Amgen v. Sandoz. As we covered previously, after the Federal Circuit denied the parties’ petitions for rehearing en banc in Amgen v. Sandoz, a 90-day clock began running on the parties’ time to file a cert. petition to the Supreme Court. That 90-day window is currently set to close on January 14, 2016. Sandoz has now asked the Chief Justice to extend the deadline to February 16, 2016.
Seeking an extension on this deadline does not commit Sandoz to actually file a petition.
