As we reported yesterday in the Amgen v. Hospira litigation, Amgen filed a motion for leave to file an amended brief in support of its Motion for a Preliminary Injunction, in light of the Supreme Court’s ruling in Sandoz v. Amgen. That same day, the Court entered an order granting Amgen’s request and setting forth a briefing schedule, with briefing complete by mid-July.
We also previously reported that Hospira filed a motion for summary judgment of non-infringement. Briefing on the motion completed on June 9, 2017, and the Court has scheduled oral argument for June 28, 2017, at 9:00 a.m.
